§ 1 Scope and Contracting Party
(1) These General Terms and Conditions (hereinafter “GTC”) apply to all purchase contracts concluded via the online shop of Audio Everywhere – Stefan Visbach (hereinafter “Seller”).

(3) These GTC apply to consumers (§ 13 of the German Civil Code, BGB) as well as entrepreneurs (§ 14 BGB). Conflicting terms and conditions of the buyer shall not apply unless the Seller expressly agrees in writing.
(4) A consumer within the meaning of these GTC is any natural person concluding a legal transaction for purposes that are predominantly outside their trade, business, or profession.
(5) These GTC apply exclusively to the online shop at www.audio-everywhere.com. For sales via third-party platforms (eBay, Amazon, Otto, Idealo) as well as in-store sales (POS), the respective platform conditions and separate agreements apply.
§ 2 Offer and Contract Formation
(1) The presentation of products in the online shop does not constitute a legally binding offer but rather an invitation to submit an offer (invitatio ad offerendum).
(2) By clicking the “Buy now” / “Order with obligation to pay” button, the buyer submits a binding offer to purchase the items in the shopping cart.
(3) The Seller may accept this offer within 2 business days by:
- sending an express order confirmation by email,
- dispatching the ordered goods, or
- requesting payment upon receipt of the order.
(4) The contract language is German. For international orders, English may be used as a communication language; however, the German version of these GTC remains authoritative.
§ 3 Product Description, Item Condition and Condition Statement
(1) The Seller offers both new and used items. The condition of each item is expressly stated in the product description.
New Items
New items are factory-sealed, unused, and meet the manufacturer’s standard. The full statutory warranty rights apply (2 years).
Used Items
(2) Used items are second-hand products. They may show signs of use. The exact condition is described using the following categories:
- Few signs of use: The item shows only minor signs of use and is fully functional.
- Visible signs of use: The item shows visible signs of use and is fully functional. The specific signs are documented in the product description and photos.
B-Stock
(3) B-Stock items are new products with opened or damaged original packaging. B-Stock items may show minor signs of use or individual defects, which are expressly listed in the respective product description. The item itself is otherwise functional and new. Defects beyond those listed are covered by statutory warranty rights.
For B-Stock items:
- The packaging is opened or damaged.
- Any signs of use or defects are listed in full in the product description.
- The item is functional unless expressly stated otherwise.
- Statutory warranty rights apply (2 years from handover).
(4) Photos in the listing show the actual item. Deviations due to screen display are possible and do not constitute a defect.
(4) Defective items are offered exclusively via in-store (POS) or eBay and are expressly labeled there as “defective” or “for repair”. No defective items are offered in the online shop at www.audio-everywhere.com.
(5) Unless expressly listed in the product description, no accessories (remote controls, cables, original packaging, etc.) are included in the scope of delivery.
§ 4 Prices and Payment Terms
(1) All prices are final prices in euros (€) and include statutory VAT. Additional shipping costs are shown separately during the order process.
(2) For deliveries to non-EU countries (third countries), additional customs duties, taxes, and fees may apply, which are borne by the buyer.
(3) The following payment methods are available:
- PayPal – payment via PayPal account or guest checkout
- Credit card (Stripe) – Visa, Mastercard, American Express
- Klarna – installments, invoice purchase, or instant transfer (subject to credit check)
- Bank transfer in advance – goods are shipped after payment is received
- Purchase on account – only for selected customers by prior agreement
(4) When paying by bank transfer in advance, the account details can be found in the order confirmation. The amount must be transferred within 7 days.
(5) The purchase price claim is due immediately upon conclusion of the contract. In the event of late payment, the Seller is entitled to charge default interest at the statutory rate (§ 288 BGB).
§ 5 Delivery, Shipping and Processing Times
Processing Times
(1) Order processing and shipping take place after receipt of payment within the following periods:
- Used items: 1–2 business days
- New items: Processing time varies by item and is stated on the respective product page. Please note the stated time before placing your order.
⚠️ Extended processing time for deliveries to third countries above €1,000: For orders with a goods value of more than €1,000 (gross) shipped to third countries (non-EU countries), the processing time is 2–5 business days – regardless of item condition. This is due to required export documentation, customs papers, and security checks.
Shipping Methods
(2) Depending on size and weight, shipping is handled by the following providers:
- Parcel shipping: DHL, DPD or Hermes (selected by the Seller)
- Freight forwarding: For bulky or heavy equipment (e.g. loudspeakers, amplifiers over 30 kg). Delivery is curbside unless expressly agreed otherwise.
- Local pickup: By prior appointment in 38644 Goslar. No shipping costs.
(3) The risk of shipment is borne by the Seller for consumers until handover. For entrepreneurs, the risk passes upon handover to the shipping company.
(4) For deliveries outside the EU, the buyer is responsible for compliance with any import restrictions, customs duties, and national regulations. Delays caused by customs are not the responsibility of the Seller.
(5) Delivery times are non-binding guideline values unless a fixed delivery date has been expressly promised.
§ 6 Retention of Title
(1) The delivered goods remain the property of the Seller until full payment of the purchase price.
(2) The buyer is not entitled to pledge the goods subject to retention of title or to transfer them as security.
(3) In the event of seizures or other third-party access to the goods subject to retention of title, the buyer must inform the Seller without delay.
§ 7 Right of Withdrawal for Consumers

Right of Withdrawal
You have the right to withdraw from this contract within fourteen days without giving any reason.
The withdrawal period is fourteen days from the day on which you, or a third party named by you who is not the carrier, take possession of the goods.

by means of a clear statement (e.g. a letter sent by post or an email) of your decision to withdraw from this contract. You may use the attached model withdrawal form, but it is not mandatory.
To meet the withdrawal deadline, it is sufficient that you send your notice of exercising your right of withdrawal before the withdrawal period has expired.
Consequences of Withdrawal
If you withdraw from this contract, we will refund all payments received from you, including delivery costs (with the exception of additional costs resulting from your choice of a delivery method other than the least expensive standard delivery offered by us), without undue delay and no later than fourteen days from the day on which we receive notice of your withdrawal. For this refund we will use the same means of payment that you used for the original transaction; under no circumstances will you be charged any fees for this refund.
We may withhold the refund until we have received the goods back, or until you have provided evidence that you have returned the goods, whichever is earlier.
You must return or hand over the goods to us without undue delay and in any event no later than fourteen days from the day on which you notify us of your withdrawal. The deadline is met if you send the goods before the period of fourteen days has expired.
Return shipping costs:
- Defective or incorrect delivery: If an item arrives defective or not as described, Audio Everywhere bears the full return shipping costs. Please contact us before returning at info@audio-everywhere.com so that we can issue a return label.
- Withdrawal without defect (at buyer’s request): If you exercise your statutory right of withdrawal without the goods being defective, you bear the direct cost of returning the goods yourself. This also applies to deliveries from abroad.
You will only have to compensate for any diminished value of the goods if such diminished value results from handling them in a way other than what is necessary to establish their nature, characteristics, and functioning.
Exclusions from the Right of Withdrawal
Pursuant to § 312g (2) BGB, there is no right of withdrawal for:
- goods that are not prefabricated and are manufactured based on an individual selection or specification by the consumer, or that are clearly tailored to personal needs (§ 312g (2) No. 1 BGB);
- sealed goods that are not suitable for return for reasons of health protection or hygiene, if their seal has been removed after delivery (§ 312g (2) No. 3 BGB).
Entrepreneurs within the meaning of § 14 BGB have no statutory right of withdrawal.

§ 8 Warranty and Liability for Defects
New Items
(1) For new items, the statutory warranty period of 2 years from handover of the goods applies (§§ 434 ff. BGB).
(2) In addition, a manufacturer’s warranty may apply according to the manufacturer’s warranty terms. The manufacturer’s warranty exists alongside the statutory warranty but does not replace it.
Used Items
(3) For used items, the statutory warranty period is reduced to 1 year from handover pursuant to § 476 (2) BGB. This reduction applies exclusively to consumers.
(4) Signs of use mentioned in the product description or visible in the photos do not constitute a defect.
Exclusions
(5) The warranty does not cover defects caused by:
- improper handling or installation by the buyer,
- unauthorized interventions or repair attempts by the buyer or third parties,
- normal wear and tear,
- external influences (e.g. overvoltage, humidity, drops).
(6) For defects, please contact us by email at info@audio-everywhere.com with a description and photos. The Seller has the right to remedy the defect (repair or replacement). If two attempts at remedy fail, the buyer may demand withdrawal from the contract or a price reduction.
(7) For entrepreneurs: Defects must be reported in writing without delay, no later than 7 days after receipt (§ 377 HGB), otherwise the goods are deemed accepted.
§ 9 Limitation of Liability
(1) The Seller is liable without limitation for damages arising from injury to life, body, or health, as well as for damages caused intentionally or by gross negligence.
(2) Otherwise, the Seller’s liability for slightly negligent breaches of duty is excluded, provided that no essential contractual obligations (cardinal duties) are breached.
(3) The Seller is not liable for delays caused by:
- customs or import authorities of the destination country for international shipments,
- force majeure (natural disasters, pandemics, strikes, government orders),
- errors or failures of shipping providers.
§ 10 Special Provisions for International Shipping
Customs and Import Duties
(1) For deliveries to countries outside the European Union (third countries), additional costs may apply in the destination country, which are borne exclusively by the buyer. These include in particular:
- Import duties
- Import VAT
- Customs clearance fees charged by the carrier
- Other official charges and fees of the destination country
These costs are not included in the purchase price or shipping costs shown and are not covered by Audio Everywhere. The buyer is responsible for informing themselves of any costs payable in the destination country before placing an order. If the buyer refuses to accept the shipment due to these costs, they shall bear the resulting return shipping costs and any applicable customs fees in full.
Extended Processing Time
(2) For orders with a goods value of over €1,000 (gross) shipped to third countries, the processing time is 2–5 business days (instead of the regular 1–2 business days). This extended period is used to prepare the necessary export documents, customs paperwork, and security checks.
Export Control
(3) Certain products may be subject to export restrictions. The Seller reserves the right to refuse orders if export is not legally permitted. In such cases, the buyer will receive a full refund.
Returns from Abroad
(4) For returns from abroad, the buyer bears the full return shipping costs including any customs duties. Please coordinate returns in advance by email.
Delivery Restrictions
(5) The Seller reserves the right to refuse deliveries to certain countries, in particular countries subject to international sanctions.
§ 11 Data Protection
Information on the processing of your data can be found in our Privacy Policy at www.audio-everywhere.com. The Privacy Policy is part of the contractual relationship.
§ 12 Dispute Resolution and Applicable Law
(1) The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
(2) The place of jurisdiction for merchants is Goslar. For consumers, the general place of jurisdiction applies.
(3) The European Commission provides a platform for online dispute resolution (ODR): https://ec.europa.eu/consumers/odr/
(4) The Seller is neither willing nor obligated to participate in dispute resolution proceedings before a consumer arbitration board.
§ 13 Final Provisions
(1) Should any provisions of these GTC be invalid, the validity of the remaining provisions shall remain unaffected (severability clause).
(2) Amendments or supplements must be made in writing or by email. No verbal side agreements exist.
(3) The Seller reserves the right to amend these GTC at any time with effect for future orders.
